Terms and Conditions
PART ONE: Design Work Contract
This will be presented to every customer at the start of a project and will include the following information:
1. Names, dates and contact information:
Customer Name
Company Name
Tel
Email
Website
2. Scope of work
Details of what is required including key dates / milestones
3. Quote for works
Either based on hourly rate or by project (see below for details)
PART TWO: Ts & Cs
1. Copyright and ownership
Copyright of the completed web designs, images, pages, code and source files created by the Designer for the project shall be with the Client upon final payment only by prior written agreement. Without agreement, ownership of designs and all code is with the Designer.
These terms of use grant a non-exclusive limited license so that the Client can use any web design on one website on one domain name only. For logo designs, a set of guidelines will be provided to ensure brand integrity when used for print / screen purposes.
The Client agrees that resale or distribution of the completed files is forbidden unless prior written agreement is made between the Client and the Designer.
2. Payment information
• Our hourly rate is £50
• Or we can quote by project
• Initial deposit will be required by all new customers
• Payment due date: for new customers – on receipt of an invoice. 30 days can be agreed for existing customers
• Preferred payment method is BACS transfer
• interest will be charged on late payment fee
3. We have liability insurance to protect from transactions that carry a risk of liability arising from things like:
• Breach of contract
• Negligence
• Misrepresentation
• Infringement of intellectual property (IP) rights
It deals with circumstances that neither party could have reasonably foreseen and help keep compensation amounts reasonable.
4. Termination clause
The client has the right to cancel design work at any time.
AVD will send an invoice for the hours logged on a project so far, please note this includes any preparatory hours even if the design is not finished.
